Dawn has occasion to report on so many dreadful court decisions that it seems incumbent to note those rare cases in which judges manage to get it right; on Dawn's ever-so-short list of sensible decisions in sex-related
cases is one from Australia.
It seems Richard Budlong was fired from his job at the technology firm NCR/Australia after it was discovered he had 175 pornographic images on his work computer. The naughty pictures, some allegedly depicting acts
of bestiality (the species involved were not noted in reports Dawn saw...), were stored on Richard's laptop ina folder aptly labeled "amusements."
The New South Wales Industrial Relations Commission found that NCR's alleged "zero tolerance" policy regarding porn at work existed only on paper, and that there was too much "air of automaticity" in employees' signing
off on NCR's code of conduct to make its fine print enforceable. They concluded that sacking Mr. Budlong was "harsh, unreasonable, and unjust." Bravo.
